Term of Service
Effective Date: October 12, 2024


1. Introduction

  Welcome to aiassistworks.com ("we," "us," or "our"), a Google Workspace add-on provided by PT Visi Cerdas Digital ("Company"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with these Terms, please do not use our Service.


2. Eligibility

   By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.


3. Use of Service

   You agree to use the Service only for lawful purposes and following these Terms. You agree not to:

  • Violate any applicable laws or regulations.
  • Use the Service for any fraudulent, harmful, or unlawful activity.
  • Violate any terms of service by the AI provider.

 

4. User Accounts

To use our service, you may be required to sign in. When you sign in, you agree that:

  • We will use your email when signing in with a Google account for billing and communication purposes.
  • You cannot share your account with anyone else for security reasons. Anyone with access to your account can use this add-on and your API credit. You are responsible for any misuse of the account because of this.


5. Subscription and Payment

   The Service may offer subscription plans. By subscribing, you agree to:

  • Pay the subscription fees and any applicable taxes.
  • Provide a valid payment method.
  • Authorize us to charge your payment method on a recurring basis for the subscription fees and any applicable taxes.
  • Ensure that your payment information is accurate, complete, and up-to-date.
  • We use Paddle to process payments and manage subscriptions. You agree to Paddle's Terms of Service and Privacy Policy by subscribing to our Service.


6. Third-Party Services

  • We comply with Google API Services User Data Policy, including Limited Use requirements,
  • You are required to use your own AI API key to access AI services. Using these API keys, you agree to the respective AI providers' Terms of Service and Privacy Policy. It is your responsibility to review and comply with these policies.
  • By using our Service, you agree that you will be billed by the AI provider for which you provide the API key based on the number of tokens used. You agree that you are responsible for paying any fees associated with those providers. Billing will be managed either through your credit or at the end of the month, depending on the terms set by the AI provider.
  • When using your AI API key, you acknowledge that we may share the content you select to process with the AI provider for the purpose of obtaining AI-generated results.
  • We utilize several third-party services to support our operations. These include BoldDesk for helpdesk, Boathouse.co for our billing portal, Postmark for email delivery, and Cookiebot for cookie consent management.


7. AI Policy

  • The AI services provided through our platform can make mistakes. You are responsible for checking the accuracy and reliability of the AI-generated results.
  • You agree not to use AI-generated content in scenarios where inaccuracies can lead to dangerous or high-risk outcomes, such as in medical, legal, or financial advice.
  • Examples of inappropriate use include but are not limited to making health diagnoses, providing legal counsel, or making financial decisions solely based on AI-generated content.
  • You are responsible for the content generated using the AI, ensuring that it does not contain false claims, hoaxes, or spread fake information. Additionally, you must avoid creating large amounts of content that provide no additional value to users.


8. Data Privacy and Protection

  • Explanation of Data Practices: We collect personal information such as your email address when you sign in to use our Service. This data is used to manage your account and communicate with you. We store your data securely and protect it using industry-standard measures. Your data is only shared with third parties (such as billing providers -Paddle) as necessary to provide our Service, and these third parties are required to adhere to our data protection standards.
  • Payment Information: We do not handle your payment information directly; this is processed by our third-party service, Paddle, which complies with payment industry security standards.
  • User Rights: Users have the right to access, correct, delete, and request the portability of their personal data. To request data deletion, please email us at support@aiassistworks.com.
  • API Key and Data Storage: We do not store your API key, prompts, results from AI providers, or content of your sheets on our server .Your API key is stored encrypted on your account. When using your AI API key, you acknowledge that we may share the content you select to process with the AI provider for the purpose of obtaining AI-generated results.
  • Logging:  We collect anonymous logs of how users utilize our service, including which AI provider or model is used, the number of tokens used, the number of cells processed, and the input/output range in A1 notation format. This data is collected for the purpose of debugging, identifying issues, and improving our service.
  • Managing access for Google data: You can manage access to your Google Account at any time by visiting the Google Account Permissions page. Here, you can view and revoke access for apps and services that have access to your account data.

9.Refund Policy

  • For monthly subscriptions, you may receive a full refund if you cancel within 7 days of your initial subscription. After 7 days, no refunds will be provided.
  • For yearly subscriptions, you may receive a full refund if you cancel within 30 days of your initial subscription. After 30 days, no refunds will be provided.
  • If you request a refund, your subscription will be immediately downgraded to the free plan at the end of the refund period. If you simply want to cancel for the next billing cycle, no refund will be provided.
  • In special cases, we may provide a refund beyond the standard refund period above. If you believe you deserve a refund, please contact us with your specific reason for the request.

10.Termination

    We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease, and we may delete your account and any associated data.

  • User Termination Rights: Users can cancel the service anytime. The user may be eligible for a refund if the cancellation occurs within the refund period specified in our Refund Policy.
  • Data Handling: Upon termination, users can request the deletion of their data by emailing us at support@aiassistworks.com. We will delete all user data within 30 days of the request.


11. Free Plan Users

    We reserve the right to stop offering the Free plan at any time in the future, with or without notification to you. We have no obligation to continue providing the Free plan or any of its features.


12. Limitation of Liability

    To the fullest extent permitted by law, aiassistworks.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service.
  • Any interruption or cessation of transmission to or from the Service.
  • Any bugs or errors in our Service.
  • The availability or reliability of third-party services such as AI providers, payment processors, and help desk services.
  • The availability or reliability of Google services.

This limitation of liability does not exclude or limit our liability for gross negligence or willful misconduct.


13. Indemnification

    You agree to defend, indemnify, and hold harmless aiassistworks.com, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.


14. Dispute Resolution

  • Arbitration Clause: Any disputes arising out of or relating to these Terms or using the Service shall be resolved through binding arbitration. The decision of the arbitrator shall be final and binding on the parties.
  • Process Description: In the event of a dispute, users must first contact us at support@aiassistworks.com to attempt to resolve the issue informally. If the dispute is not resolved within 30 days, either party may initiate arbitration by submitting a written demand for arbitration. The arbitration will be conducted in Indonesia, and the arbitrator will issue a written decision explaining the outcome and the reasoning.
  • Jurisdiction: These Terms and any disputes related thereto will be governed by the laws of Indonesia, without regard to its conflict of laws principles. Any legal proceedings related to these Terms shall be brought in the courts located in Indonesia.


15. Communication with Users

  • Communication Methods: We will communicate with users primarily via email. Important notifications, such as changes to terms or privacy policies, will be sent by email. General updates, such as new features, tips, and promotions, will be sent regularly.
